从实践和理论层面理解宅基地财产化改革的最新进展、特征及深层逻辑,有助于准确客观评价宅基地制度改革试点,反思流行理论框架。实践中主要有五类宅基地财产化路径,包括:宅基地有偿选位、宅基地内部流转、农房抵押贷款、闲置农房盘活、宅基地入市,不同路径有不同运行机制,同时有严格约束条件,形成宅基地配置的“有限市场”特征。限制宅基地财产化的深层逻辑包括:宅基地制度的功能仍主要保障户有所居;宅基地制度改革要有利于农村土地管理;宅基地制度要和中国土地制度的整体宪法秩序相协调。评估宅基地制度改革试点需要多元标准体系,消除单一赋权标准造成的片面性问题。 |

Abstract: |
To understand the latest progress, characteristics and deep logic of homestead property reform from the practical and theoretical level is helpful to accurately and objectively evaluate the homestead system reform pilot and reflect on the popular theoretical framework. In practice, there are mainly five kinds of approaches to the property of homestead, including: the paid location selection of homestead, the internal circulation of homestead, the mortgage loan of farm house, the activation of idle farm house, and the market entry of homestead. Different paths have different operating mechanisms and strict constraints, forming the "limited market" feature of homestead allocation. The deep logic of restricting the property of homestead includes: the function of homestead system is still mainly to ensure that households live; the reform of homestead system should be conducive to rural land management; the homestead system should be coordinated with the overall constitutional order of China''s land system. To evaluate the pilot reform of homestead system, we need a multi standard system to eliminate the one-sided problem caused by a single empowering standard. |
