农村集体产权制度是乡村有效治理的经济社会基础。不同于西方经济意义上的私有产权,中国特色的农村集体产权是一种复合产权,它既是一个“权利束”,也是一个“关系束”,兼具市场性、社区性与国家性。T省产权改革的经验显示,在盈利型、保护型与服务型集体经济形态下,复合产权依次“裂变”为股份经济合作社、集体经济合作社与村委会代行职能三种改革路径,并形成了公有共管共享、公有共管与公有三种分配秩序。在“产权—分配—权力”的链式框架中,复合产权属性通过集体分配秩序的中介作用影响公共权力配置,形塑出多元主义、法团主义与精英主义三种乡村治理模式。这说明,作为“自变量”的产权具有明显权力配置效应,产权与权力的优化嵌套有助于促进乡村善治。 |

"Fission" of Compound Property Rights: Power Allocation Effect of Rural Collective Property Rights Reform——Take three provinces'' collective property rights reform paths as examples |

The rural collective property rights system is the economic and social basis for effective rural governance. Different from the private property rights in the western economic sense, the rural collective property rights with Chinese characteristics is a kind of compound property rights, which is not only a “bundle of rights” but also a “bundle of relations”, and it has both marketability, community and nationality. The experience of province T"s property right reform shows that in the form of a profit-oriented, protected and service-type collective economy, compound property rights have “fissioned” into three types of reform paths, namely, joint-stock economic cooperatives, collective economic cooperatives, and village committees. There are three distribution orders: public ownership, shared ownership, public ownership and public ownership. In the chain structure of "property rights-distribution-power", the compound property rights influence the allocation of public power through the intermediary role of the collective distribution order, shaping the three rural governance models of pluralism, corporatism, and elitism. This shows that property rights as "independent variables" have obvious power allocation effects, and the optimized nesting of property rights and power helps to promote good governance in rural areas. |
